For the respondents Mr. Mukherjee, learned advocate for the appellants, submits that the respondents were inducted as tenants in the premises in question. However, some disputes arose between the parties, which have now been amicably settled out of court. In accordance with the terms and conditions of the settlement, the respondents agree to hand over vacant possession of the suit premises to the appellants upon verification of the appellants' ownership of the property as of the present date. The respondents have also notified their intention to do so in the newspapers. Mr. Mukherjee submits that, in this context, the appellants do not want to proceed with the appeal and its connected application.

The written instruction and the documents, as submitted on behalf of the appellants, be taken on record. Mr. Drolia, learned advocate representing the respondents, enters appearance on behalf of the respondents.

Taking note of these subsequent developments, the prayer made on behalf of the appellants to withdraw the appeal and its related application is granted. Accordingly, the appeal and its connected application are dismissed as withdrawn. There shall, however, be no order as to costs.
