Affidavit of service so filed be kept with the record. The petitioners happen to be the resident of Telengana. It is submitted that they have been implicated in connection with Katwa P.S. Case No. 16 of 2021 dated 14th January, 2021 as they are the parents-in-law of the opposite party no.2.
The case arose out of a matrimonial discord and pursuant to the registration of the present case, the Investigating Agency has already submitted chargesheet before the jurisdictional court. In view of the nature of allegations, I am of the opinion that regular attendance of these petitioners from Telengana may not be warranted in respect of the day-to-day proceedings at Katwa. The learned Magistrate is directed that in case an appropriate application is filed under Section 205 of the Code of Criminal Procedure, the learned Magistrate would after assessing the necessary requisites for compliance under Section 205 of the Code
of Criminal Procedure dispense the personal appearance of the petitioners until and unless without their physical presence the trial of the case cannot proceed.
With the aforesaid observations, CRR 1058 of 2021 is disposed of.
