The habeas corpus petition is preferred at the instance of the father of a girl of seventeen years, who went missing.

A contemporaneous complaint was lodged with the concerned Police Station which yielded no result that compelled the father of the missing girl to approach this Court with the present application seeking direction in the nature of habeas corpus.

When this habeas corpus petition is taken up for hearing, it has been submitted by Sk. Sahjahan Ali Learned Advocate on Record for the petitioner that the girl of the petitioner has been recovered and he does not want to proceed with the present petition.

Mr. Rana Mukherjee, Learned Additional Public Prosecutor with Mr. Shabir Ahmed, Learned Counsel appear on behalf of the State-respondents submits that due to recovery of the missing girl during pendency of the

habeas corpus petition the petition needs to be disposed of since it has become infructuous.

Considering the submissions made on behalf of the parties, the habeas corpus petition stands disposed of in consideration of the fact that the missing daughter of the petitioner was recovered during pendency of this habeas corpus petition.

WPA(H) No. 31of 2021 stands disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on compliance of necessary formalities.
