It is contended that the petitioner is having to bear alimony for the opposite party indefinitely, due to multiple interlocutory applications being filed by the opposite party in the connected suit.
Since the suit is itself for a declaration of nullity of marriage, it is argued that it would be fruitless to keep the matter pending for an indefinite period.
Learned counsel for the opposite party, in his usual fairness, submits that there is no objection
on the part of the opposite party, in the event the applications are disposed of expeditiously.
In view of the above submissions, CO No.934 of 2021 is disposed of by requesting the Additional District Judge, Sixth Court at Alipore, District: South 24 Parganas to dispose of all the applications pending in the said court in connection with Matrimonial Suit No.61 of 2013, without granting any unnecessary adjournments to either side, within two months from the date of communication of this order to the court below.
The court shall thereafter dispose of the suit itself as expeditiously as possible, positively within six months from the date of disposal of the pending applications.
The time-frames set above are peremptory and have only been prolonged keeping in view the difficulty faced by the District Courts in staggered functioning due to the prevalent pandemic.
The court below shall act on the communication of the learned advocates for the parties, accompanied by a server copy of this order, without insisting upon prior production of a certified copy thereof.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
