None appears on behalf of either sides on repeated calls.

The present writ petition of the year 2009 has been preferred praying for direction upon the respondents to withdraw the order dated 03.02.2009. By the said order dated 03.02.2009 the 1st Industrial Tribunal was to decide on the following issues : "1. Whether termination of service of Shri Nand Kishore Pashi with effect from 03-10-2006 is justified?

2. To what relief, if any, is he entitled?"

Being aggrieved the present writ application has been preferred.

On perusal of the said order, this Court finds no illegality in the same and the matter is pending since long though the employee therein has been terminated. None appears on behalf of either sides.

Considering the said fact, the writ petition is dismissed for default.

WPA 6231 of 2009 is accordingly disposed of.

There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Let a copy of this order be sent to the learned 1st Industrial Tribunal, Kolkata, to decide on the said issues as framed vide order dated 03.02.2009 by the Deputy Secretary to the Government of West Bengal with notice to both the parties. Copy also be sent to the Labour Commissioner and the Secretary, Labour Department. (Shampa Dutt (Paul), J.)
