The petitioners complain that despite cooking under the midday meal programme as per arrangement with the respondent No.6, they are not receiving the cost of materials and remuneration for services rendered.

The respondent No.6, the petitioner and other selfhelp groups have agreed between themselves for cooking meals at Samantapara F.P. School, Uttar Mokamberia Gram Panchayet of Narayantala since 2003. The petitioners seek mandamus on the BDO concerned to ensure that they receive payments from the respondent No.6.

This Court notes that the petitioners'

grievance is primarily against the private respondent No.6. This Court sees no public

element in the writ petition or the grievance of the writ petitioners.

Hence, the instant writ petition fails and is hereby dismissed.

The BDO, Basanti, shall ensure that the midday meal programme in the Samantapara F.P. School, Mokamberia is not interrupted under any circumstances. He shall take all and any measures towards ensuring the same.

Since the respondents have not used any affidavit in opposition, none of the allegations in the writ petition shall be deemed to have been admitted.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
