Kundu ...for the State On the last occasion it is clearly admitted by the learned P.P.-in-charge that the petitioners are the Indian citizens. However, they were apprehending while they were coming from Bangladesh to India and they could not produce any visa.
Since the petitioners have their valid documents and they are the permanent citizens of India, I am inclined to release them on bail.
The petitioners are enlarged on bail of Rs.10,000/- each with one surety to the satisfaction of the learned Additional Chief Judicial Magistrate, Basirhat with further condition that they shall not leave the jurisdiction of Gaighata Police Station till the disposal of the case pending against them in the Court of the learned Additional Chief Judicial Magistrate, Basirhat except for the purpose of attending hearing of the case. If the petitioners require to go outside the jurisdiction of Gaighata Police Station, they shall take permission from the learned Additional Chief Judicial Magistrate, Basirhat. The instant application is, thus, disposed of. (Bibek Chaudhuri, J.)
