Mr. Husen Mustafi Mr. Subhajit Chowdhury .....For the Petitioner The present revisional application has been preferred in respect of an order passed by the learned Additional District & Sessions Judge, Fast Track Court, Barrackpore in Criminal Revision No.76 of 2023, wherein the learned revisional court was pleased to grant an interim order of stay subject to payment of Rs.2,500/- per month from the date of passing of the order. Petitioner is aggrieved by the same. However, having regard to the fact that the revisional application is pending, I am not inclined to interfere, at this stage, however, I direct the learned revisional court to dispose of the revisional application on the next date so fixed or within a month thereafter. Learned revisional Court would take into account the factum that only by way of assigning special reasons, an order of maintenance can be given effect to from the date of the order, otherwise the same should be from the date of filing of the application.

With this above observation, C.R.R. 1229 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
