Matter relates to transfer of the petitioner and an application was made on Utsashree Protal on 6th June, 2022 seeking transfer on general ground (distance).

The school authority where petitioner was working forwarded the transfer application to the concerned District Inspector of Schools (SE) for taking further steps. The District Inspector of Schools (SE) in his turn processed the transfer application and forwarded the same to the West Bengal Central School Service Commission for taking final decision. Grievance of the petitioner is in spite of receipt of transfer application on 25th June, 2022 till date no decision has been taken.

West Bengal Central School Service Commission is represented by learned advocate who has submitted due to suspension of portal with effect from 29th September, contemporaneous decision on transfer application could not be taken. However, it is further submitted if concerned authority is directed transfer application of the petitioner shall be decided in accordance with law.

Having considered the submissions made on behalf of the parties writ petition stands disposed of directing Chairman, West Bengal Central School Service Commission being respondent no. 4 to decide the transfer application of the petitioner by 8 (eight) weeks from the date of communication of this order and the decision to be taken shall be communicated to the petitioner by 10 (ten) days thereafter.

It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
