Mrs. Ratna Ghosh ..for the State Petitioner is directed to serve a copy of the revisional application upon the Mrs. Ratna Ghosh, learned advocate who ordinarily appears on behalf of the State. Her appearance may be regularised by the concerned authorities.

Learned advocate for the petitioner has expressed his anxiety regarding the factum of the petitioner being in custody since January 15, 2022 i.e. 18 months. Learned advocate submits that charge in this case was framed on February 10, 2023 and till date no witness has been examined although the prosecution has relied upon 9 witnesses to prove its case and all of them belonging to the Government Department. In view of the anxiety expressed by the learned advocate for the petitioner who is in custody for more than 18 months I am of the view that the same is justified. As such no unnecessary adjournment be granted to either of the parties. The learned Public Prosecutor conducting the case would produce the

materials, exhibits and documents on the date so fixed. Examine all the witnesses.

In case no witness appears on a particular date the Special Court would communicate the same to the Office of the Superintendent of Police/Commissioner of Police who is supposed to maintain registrar for ensure progress of the case. The said office would ensuring regarding production of witness(s) on the dates fixed.

All stakeholders are directed to cooperate with the learned Trial Court to conclude the trial at the earliest. With the aforesaid observation this revisional application being CRR No. 1230 of 2023 is disposed of.

The connected application, if any, stands disposed of accordingly.

There shall however be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh,J)
