For the Respondent nos. 3 & 4 The petitioner has challenged the Memo bearing no.439 dated June 30, 2017, whereby the petitioner has been placed under suspension w.e.f. July 1, 2017 on the ground that in pursuance of the said show-cause notice no departmental enquiry has been initiated by the respondent authorities.
Mr. Chowdhury, learned Counsel appearing on behalf of the petitioner informs this Court that during the pendency of the writ petition departmental enquiry has been started against the petitioner.
In view of such development of the matter, the writ petition has become infractuous and is accordingly dismissed.
So far as the claim of the writ petitioner regarding subsistence allowance during the period of suspension is concerned, it is made clear that this Court has not gone into the merit of such claim and the petitioner is at liberty to raise the said issue before the appropriate forum of law.
