A direction to secure expeditious disposal of Title Suit No.69 of 2008 pending before the learned Civil Judge (Junior Division), 1st Court, Barrackpore, is the ultimate relief sought for in this case.
Admittedly, the petitioners are the plaintiffs/landlord in a suit already instituted for eviction of defendants. The only contention expressed by the learned advocate for the petitioners is against the delay caused in the disposal of a suit. Incidentally, it is submitted by the petitioners that the suit is getting delayed due to non-submission of learned Commission's report together with non-filing of additional written statement. No other point is raised requiring address by this Court.
In view of the nature of order proposed to be made in the case, no prior notice is considered to be necessary. Service upon the opposite party is thus dispensed with. Accordingly, learned Civil Judge (Junior Division), 1st Court, Barrackpore in Title Suit No.69 of 2008 is requested to ensure submission of learned Inspection Commissioner's report expediting the same in the interest of adjudication of
the matter in controversy expeditiously, but without granting unnecessary adjournment, unless it is extremely unavoidable. While endeavouring such exercise, the learned Court below may proceed that the disposal of suit, upon collection of the learned Commission's report together with required observance of formalities, in the manner, as situation of the case would demand, so as to dispose with the justice in best possible expeditious manner.
Petitioners are directed to make communication of this order to the learned Court below as well as to the learned advocate appearing in the Court below for the opposite party and the opposite party.
With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings. .
