Ms. Ishika Khan, Ms. Aphipha Khan ...for the petitioner In this application petitioner has prayed for a direction upon the Court below for expeditious disposal of the complaint case being 185 of 2018 presently pending before Judicial Magistrate, Municipal Court, Howrah.

The petitioner alleged that over the allegation of bouncing a cheque issued by the opposite party herein, petitioner preferred the aforesaid complainant case on 15.03.2018. Thereafter on 25.06.2018 plea was taken and the matter was fixed on 31st August, 2018. Since then only P.W.1 was examined in part and next date is fixed on 06.05.2026. Petitioner being the complainant is suffering a lot due to long pendency. She further alleged that the accused/opposite party is taking unnecessary adjournment and thereby prolonging the proceeding. Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of her submission, opposite party will have no cause to prejudice, and, as such, the service of copy of application upon the opposite party is dispensed with.

Having heard learned Counsel for the petitioner and that the prayer made by the petitioner is justified, the instant application being CRR 1540 of 2026 is hereby disposed of with a direction upon the Court

below to conclude the trial without granting any unnecessary adjournment to either of the parties preferably within a period of six months from the next date of hearing.
