In view of the report submitted by the Officer-in-Charge, Naihati Police Station, Barrackpore Police Commissionerate, the learned special court is directed to exhaust the process of law as prayed for in respect of the absconding accused persons. The said process be completed within 90 days from the next date so fixed. Learned trial court would thereafter segregate/split up the trial and proceed in respect of the accused persons who are facing the trial. All efforts be taken by the learned trial court to consider the issue relating to charges and overcome the said stage within a period of one month from the date when it decides to split up the trial and thereafter if the learned special court is of the opinion that the trial of the case should proceed, then in that case, the learned trial court would fix a schedule consisting of three dates and fix such schedule once in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties. All
efforts be taken by the stakeholders to cooperate with the learned trial court to conclude the trial at the earliest. With the aforesaid observations, CRR 1300 of 2024 is disposed of.
Pending connected application, if any, is consequently disposed of.
Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
