Mr. Suvadip Bhattacharjee ...for the petitioner Affidavit of service filed be kept on record. The present writ application has been preferred praying for issuance of a corrigendum rectifying the date of refusal of employment in the reference dated 25.05.2023. It is submitted that the date of refusal of employment is to be taken as 09.07.2008 instead of 02.02.2011 as noted in the reference dated 25.05.2023. It is further submitted that a prayer for such correction and issuance of corrigendum submitted by the petitioner on 05.01.2024 has not been considered till date by the Assistant Labour Commissioner, Government of West Bengal, Arambagh, Hooghly.

Learned counsel for the petitioner has relied upon the judgment of the Supreme Court passed in Dabur (Dr. S.K.

Burman) Private Ltd., Deoghar, Bihar vs.

Workmen, reported in 1976 SCC OnLine SC 290:

wherein the Court permitted such corrections in reference made.

On considering the materials on record, the writ application is disposed of with the direction that the Assistant Labour Commissioner, Government of West Bengal, Arambagh, Hooghly shall dispose of the prayer of the petitioner herein dated 05.01.2024 within a period of 15 (fifteen) days from the date of communication of this order.

In case copy of the said application is not available with the Assistant Labour Commissioner, Government of West Bengal, Arambagh, Hooghly, the petitioner is at liberty to file the same.

Accordingly, WPA 8198 of 2025 stands disposed of.

Let a copy of this order be sent to the Assistant Labour Commissioner, Government of West Bengal, Arambagh, Hooghly for immediate compliance.
