The petitioners are aggrieved by the order of admission i.e. the order dated 13.06.2023 passed by learned Chief Judicial Magistrate, Paschim Medinipur in connection with Misc. Case No. 127/2023.

Having regard to the nature of the order and the issue so canvassed, I am of the view that as the statute provides appellate provision under Section 29 of the Protection of Women from Domestic Violence Act, 2005, the District and Sessions Judge should be approached first under the relevant provisions.

With the aforesaid observations, the revisional application being CRR 1297 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

Department is directed to return the certified copy to the learned advocate-on-record of the petitioners after the same is replaced by photostat copy.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
