The petitioner was granted bail by a co-ordinate Bench by an order dated April 5, 2024 passed in CRM (DB) 992 of 2024, on certain conditions. Two of the conditions were that he shall not enter the jurisdiction of Narendrapur Police Station until further orders, except for the purpose of attending court proceedings. The other condition was that he shall meet the Officer-in-Charge of the police station concerned within whose jurisdiction he is presently residing once in a week until further orders.

The petitioner has filed the present application for relaxation of the aforesaid two conditions.

In so far as the first condition mentioned above is concerned, both the learned advocates for the State and the de facto complainant vehemently oppose the prayer for waiver of the same. They say that all the witnesses are within the geographical limits of the Narendrapur Police Station. The petitioner, if allowed to enter that area, will almost certainly threaten and intimidate the witnesses. Charge is yet to be considered.

In so far as the other condition is concerned, learned advocates for the State and the de facto complainant do not have much to say since charge-sheet has already been filed upon completion of investigation.

We have considered the facts and circumstances of the case and the alleged incident which resulted in institution of this case. We are of the view that immediately we should not relax the condition of bail which restrains the petitioner from entering the jurisdiction of the Narendrapur Police Station. Hence, that condition remains.

In so far as the other condition is concerned, we dispense with the requirement of the petitioner meeting the Officer-in-Charge of the concerned Police Station, which we are told, is the Bansdroni Police Station, where he is residing now. That condition is waived. However, the petitioner shall meet any Police Officer if and when called for. All other conditions of bail shall remain unaltered.

CRAN 1 of 2024 is, accordingly, disposed of.
