He submits, his instructions are to seek withdrawal of the writ petition.

On query from Court he submits, the undertaking of petitioner to affirm and stamp the petition has not been discharged.

Mr. Baral submits he did not receive material instructions from his client to cause stamping of the petition as per Rules.

Court takes a lenient view as such that in spite of the undertaking not having been fulfilled, petitioner's prayer of not pressing the petition is accepted.

The writ petition along with application is dismissed.
