On 7th July, 2022 at the time of hearing of the instant application for extension of interim order, it was submitted by the Learned Advocate for the petitioner that the petitioner would not press for quashing of the charge-sheet being Charge-sheet No. 103/2021 dated 31st July, 2021 under Sections 419/420/120B/34 of the Indian Penal Code arising out of Bidhannagar Cyber Crime Police Station Case No. 41/2019 dated 6th June, 2019. On the other hand, the petitioner may be directed to surrender before the Trial Court and, in the meantime, warrant of arrest issued against the petitioner may be stayed.
Mr. Ranabir Roy Chowdhury, Learned Advocate for the petitioner submits that warrant of arrest may be stayed for the time being and the petitioner may be directed to surrender before the Trial Court. The Trial Court shall then act in accordance with law if the petitioner files an application for bail.
Mr. Mazumder has agreed to such proposal.
In view of such submission made by both the parties, the instant criminal revision is disposed of directing the petitioner to surrender before the Learned Additional Chief
Judicial Magistrate at Bidhannagar within four weeks from the date.
The Learned Additional Chief Judicial Magistrate, Bidhannagar is directed to dispose of the application for bail, if filed by the accused in accordance with law taking due consideration of the fact that the accused would voluntarily surrender before the Trial Court.
Connected application is also disposed of.
