06.04.2023 Ct. No. 29 CHC Rejected C.R.M.(A) 1457 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Eanglish Bazar Police Station Case No. 1240 of 2022 dated 05.08.2022 under Sections 21(C)/ 29 of the NDPS Act.

Mr. Manoranjan Mahata ....for the State There are statements recorded under Section 161 of the Criminal Procedure Code of neighbours claiming that the petitioner is involved in the business of smuggling of narcotics. Commercial quantity of narcotics were seized by the police.

Complicity of the petitioner in respect of such seized commercial quantity of narcotics transpires from the materials in the case diary.

Consequently, we are of the view that the petitioner is unable to overcome restrictions under Section 37 of the NDPS Act, 1985.

CRM (A) 1457 of 2023 is rejected.
