In spite of service, there is no representation on behalf of the State or the school authorities. 3.

The petitioner is an Assistant Teacher in Pachim Surendranagar Adarsha Banipith, South Parganas since 2013. The petitioner has applied for a transfer from the school, for which the school had duly issued "No Objection Certificate".

The transfer was sought on self medical ground of the petitioner. The petitioner has also gone

through the two-tier medical examination, first by the school and then by the concerned District Inspector of Schools.

The respondent no.4 had thereafter forwarded her recommendation to the respondent no.3 sometime in 2022.

It appears from the record that the respondent no.3 has not disposed of such application which is pending since 2022.

The respondent no.3 or the concerned authority of the Commission is directed to consider and dispose of the application of the petitioner by June 15, 2026, if the opted schools have not been notified for some other recruitment process.

In case, the opted schools are not available, concerned Commission shall provide options of available schools to the petitioner near to her preferred schools.

9.

Temporary suspension of online "Utsashree Portal"

shall not be a ground for nonconsideration of transfer application of the petitioner. The same shall be considered in an offline mode.

10. With the aforestated directions, the instant writ petition stands disposed of.

11. There shall be no order as to costs.

12. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
