(AB) Mrs. Tapati Samanta ........... for the State None appeared on behalf of the petitioner on 5th July, 2021 and on 6th July, 2021. None appears on behalf of the petitioner today.

The learned advocate for the State authority is present.

Upon perusal of the averments made and the documents annexed to the writ petition it appears that the petitioner claims to be the heir of one Kajal Rani Das who was a Librarian and who died-inharness on 13th April, 2019. The petitioner being the unmarried sister of the deceased Librarian applied before the District Library Officer and Secretary Local Library Authority praying for providing compassionate appointment to her by a representation dated 9th August, 2019.

The petitioner alleges that the said representation has not been considered till date. It also appears that representation was made before the Director of Library Services by a letter dated 19th

Mach, 2021 sent through Speed Post on 23rd March, 2021.

As it appears that the prayer of the petitioner praying for compassionate appointment is pending consideration at the end of the respondent authorities, no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the Director of Library Services to take a decision with regard to the prayer of the petitioner for being appointed on compassionate ground in the diedin-harness category strictly in accordance with law, at the earliest, but positively within a period of ten weeks from the date of communication of a copy of this order.

The said authority shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

It is made clear that this Court has not entered into the merits of the prayer of the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the representation of the petitioner.

The writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
