Learned counsel appearing on behalf of the deceased opposite party No. 23 is present.

The instant revisional application is preferred challenging the impugned order passed by the learned Trial Court by which her application filed under Order I Rule 10 of the Code of Civil Procedure was rejected. It further appears from the earlier order passed by this Court that during pendency of this revisional application sole petitioner and opposite party No. 23 were expired and opportunity was given to the learned counsel who appeared on behalf of the deceased petitioner to take appropriate steps in this regard, but till date no steps has yet been taken.

Accordingly, I find that the heirs of the deceased petitioner presently have no interest to proceed further with this revisional application and

no purpose will be served by keeping this revisional application alive.

Accordingly, the revisional application stands dismissed.

There will be no order as to costs.

Interim order, if any, stands vacated.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
