Case No.8706 of 2010, pending before learned Judicial Magistrate, 9th Court, Alipore. The case relates to offence under Section 12 of the Protection of Women from Domestic Violence Act, 2005.

Record reflects that the petitioner approached this Court at a stage when notice was issued/summons were issued and date was fixed for service return.

Having regard to the stage the petitioner approached this Court, I am of the view that the points canvassed in the revisional application are premature and as such, no interference is called for.

Accordingly, C.R.R.1197 of 2011 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
