Mr. Subir Ganguly, Mr. Sandeep Prasad Shaw ...for the State Ms. Ritu Das ...for Opposite Party No. 2 The present case was instituted at the instance of Opposite Party No. 2, primarily on account of the alleged non-payment of dues arising from the supply of certain electrical goods and services to the petitioners' company and its associated entities. The petitioners have filed the present application seeking quashing of the aforesaid proceedings. It appears that the disputes between the parties have since been amicably resolved. In this regard, the parties have jointly filed a petition of compromise before this Court, being CRAN 1 of 2026. Learned counsel appearing on behalf of Opposite Party No. 2 submits and acknowledges that a part payment has already been received and that, upon disposal of the present proceedings, the balance amount of Rs. 15 lakhs shall be paid by the petitioners to Opposite Party No. 2.

The report submitted before this Court by the investigating agency also corroborates the aforesaid position. Upon consideration of the materials on record, this Court is of the view that the dispute between the parties is essentially commercial in nature and that a valid compromise has already been arrived at between them. In such circumstances, the continuation of the criminal proceedings would amount to an abuse of the process of law.

Having regard to the principles laid down by the Hon'ble Supreme Court reported at (2012) 10 SCC 303 (Gian Singh v. State of Punjab), this Court is inclined to exercise its inherent jurisdiction to quash the present proceedings in the interest of justice.

Accordingly, G.R. Case No. 326 of 2026 arising out of Phoolbagan Police Station Case No. 28 dated 19.02.2026 under Sections 61(2)(a), 316(2), and 318(4) of the Bharatiya Nyaya Sanhita, 2023, presently pending before the Court of the learned Additional Chief Judicial Magistrate, Sealdah, stands quashed in terms of the compromise recorded in CRAN 1 of 2026. Consequently, CRR 1538 of 2026, along with CRAN 1 of 2026, stands disposed of.
