16.07.2021 Ct. No. 30 sdas dismissed CRM 3620 of 2019 (CRAN 1 of 2021) In Re : An application for relaxation of condition of anticipatory bail.

AND In Re : Riya Nag & Ors. ........ petitioners Mr. Kanailal Mondal ........... for the petitioners Ms. Sima Biswas ........... for the State The present application has been preferred for modification of the order dated 29th March, 2019 passed in CRM No. 3620 of 2019.

Learned advocate appearing for the petitioners submits that due to pandemic situation the petitioners could not surrender before the learned court below within the time as specified in the order dated 29th March, 2019. Learned advocate appearing for the State opposes the petitioners' prayer for extension of time to surrender before the learned court below.

Record reveals that by order dated 29th March, 2019 the petitioners were granted anticipatory bail with a direction that they shall appear before the court below and pray for regular bail within a fortnight from date.

However, the present application has been filed about two years after the date of disposal of the application for anticipatory bail.

We are not satisfied with the explanation given by the petitioners as regards the delay.

Accordingly, application for relaxation of conditions of bail being CRAN 1 of 2021 is dismissed.
