Learned advocate appearing for the petitioner submits that the petitioner renews his prayer for bail and brings to the notice of this Court earlier on two occasions on 26.11.2024 and 14.07.2025 the prayer for bail was rejected.

Records of the case reflect that the subject matter of seizure in the present case is 996 bottles of phensedyl and it has been submitted by the petitioner that there has been no recovery from the present petitioner and persons from whom recovery was made has already been granted bail.

Learned advocate for the State opposes the prayer for bail and submits that there were conversations between the principal accused and the present petitioner.

Records reflect that the evidence of PW29 is continuing from 29.07.2025 and till date the witness has not been completed.

Having considered that the petitioner is in custody for more than two years eleven months and there has been no recovery from the present petitioner, I am inclined to release the petitioner on bail considering the fact that the next date has been fixed in the month of June, 2026 by the learned Special Court.

As such, petitioner namely, Amitava Biswas @ Rajesh shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (NDPS Act), Nadia, Krishnanagar.

If on bail, the petitioner shall be physically present on each and every date fixed by the learned Special Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court.

Additionally, petitioner shall meet with the Officer-inCharge/Inspector-in-Charge of Chapra Police Station once in every ten days till disposal of the case.

Accordingly, CRM (NDPS) No. 663 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
