1. The petitioner prays for recalling the notice of termination issued by the Secretary of the Vivekananda Institute of Biotechnology, the institute which had an agreement with the State Bank of India.
2. It appears that the petitioner was engaged by the said institute. There is no privity of contract between the petitioner and the bank. The petitioner may have a genuine grievance against the institute which terminated the contract of the petitioner; but the same will not give any right to the petitioner to approach the Court under Article 226 of the Constitution of India seeking relief against a private body.
3. In view of the above, no relief can be granted to the petitioner in the instant writ petition. The writ petition fails and is hereby dismissed.
4. Dismissal of the writ petition will not, however, stand in the way of the petitioner to initiate appropriate proceeding(s) against the private respondent for
redressal of his grievance in accordance with law, if so advised.
5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
