AND In the matter of:- Hemanta Kumar Saha ... petitioner The present revisional application was preferred against the judgement and order dated 24.12.2010, passed by the learned Judicial Magistrate, 3rd Court, Katwa, Burdwan in connection with Misc.Case No.78 of 2008 (T.R. No.23/08) under Section 125 of the Code of Criminal Procedure.

The order dated 24.12.2010 reflects that the learned Magistrate was pleased to award Rs.2500/- per month as maintenance allowance to be paid by the present petitioner who happens to be the husband of the opposite party/wife. Having regard to the fact that the said order of maintenance was passed more than ten years ago and the quantum so awarded was a meagre amount, I am of the view that no interference is called for. Further, the revisional application reflects that the same is yet to be admitted.

Accordingly, C.R.R.1215 of 2011 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.
