The petitioners allege that the private respondents are restraining them from raising construction in their own property. The petitioners have obtained sanctioned plan for such construction. The private respondents have pulled down the wall already constructed in the property and have damaged and destroyed the material therein.

It appears from the submission made on behalf of the parties that pursuant to the complaint lodged by the petitioners before the police authority on 25th March, 2022, general diary was recorded.

On prayer of the petitioners, liberty is granted to lodge a fresh complaint before the police authority ventilating their grievance.

On receipt of such complaint the police authority shall take necessary steps in accordance with law. In the meantime, the police authority shall keep strict vigil in the area in order to avoid any untoward

incident in view of the strained relationship between the parties and shall ensure maintenance of peace and tranquility.

With the aforesaid direction the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
