Petitioner herein is aggrieved with the inordinate delay in disposal of his application filed under Section 127(1) of the Cr.P.C. for modifying the order of maintenance dated 25.06.2019. It is submitted on behalf of the petitioner that he filed the aforesaid application for alteration of maintenance amount on 27th August, 2024 and since then it is pending for disposal. Therefore, he prays for a direction upon the Court below for the disposal of the said application at the earliest. Additionally he made a prayer that since he has become jobless on and from January, 2026, such fact is also required to be incorporated in his said application by way of amendment.

Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and, as such, it is required to be allowed.

In view of above, the instant application being CRR 1555 of 2026 is hereby disposed of giving liberty to the petitioner to pray for necessary amendment in his application filed under Section 127(1) of the Cr.P.C. filed on 27th August, 2024 and the Trial Court is requested that after disposal of such amendment prayer, he will dispose of the aforesaid application filed by the petitioner under Section 127(1) of the Cr.P.C. within a period of 3 months thereafter.
