1. Learned advocate appearing on behalf of the petitioner submits as follows. There are case and counter case. A scuffle took place between two groups of individuals. Injuries were suffered on both sides. However, none of the injuries was grievous in nature.

2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She refers to the statements of witnesses and to the injury report. However, the injuries do not appear to be grievous in nature, although, an injury was inflicted on the head.

3. Considering the fact that there are case and counter case, in view of the materials available in the case diary and the fact that charge-sheet has already been submitted, I am inclined to grant anticipatory bail to the petitioner.

4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall stay outside the jurisdiction of Kaliganj Police Station for a period of six months from date except for the purpose of attending the jurisdictional Court or meeting the Investigating Officer and the petitioner shall not threaten or intimidate witnesses.

5. Accordingly, the application for anticipatory bail is allowed.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
