The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The plaintiff is alleging that the records of Title Suit no. 2076 of 1997 are not traceable, as such, the learned 3rd Bench, City Civil Court at Calcutta, where the said suit is pending has already directed to reconstruct the said records, but till date, no steps have been taken.

The learned Trial Judge is requested to take necessary steps for reconstruction of the said records. C.O. 1106 of 2023 is thus disposed of without any order as to costs.

The petitioner shall communicate this order to the opposite parties.
