Mr. Arijit Ganguly Md. Y. A. Ismail .....for the State Learned counsel appearing on behalf of the petitioner submits that the instant case arose out of a road accident. An attempt is being made to make it look like an attempt to cause murder. There is a delay of about eight days in lodging the FIR. Learned counsel appearing on behalf of the State relies on the case diary and strongly opposes the prayer for anticipatory bail. He refers to the statements of the injured witness and an independent eye witness who support the prosecution case that the accused tried to run over the victim. He points to the medical papers and submits that the injured suffered head injury apart from a fracture of right toe.

Considering the incriminating materials present in the case diary, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
