At the time of call nobody is present for the petitioner before the Court.

Mr. Biswabrata Basu Mallick, learned Advocate for the State has drawn my attention to a report already filed and kept in the record, copy whereof, according to him, was supplied to the learned Advocate for the petitioner on 8th August, 2020. Two paragraphs from this report required to be noted. "Local enquiry denotes that the said Project has been constructed in the month of August, 2018 and borings of which has been completed but the work has not been finished. The site of said project is far distance at least 10 feet from the last wall of the petitioner.

During further enquiry it could be learnt that the matter has been brought to the notice of local Panchayet. Prodhan stated her that no such land of the petitioner has been encroached by the concerned Project, if requires, Panchayat will make necessary

arrangement to measure the land in question by Amin (enclosed herewith)".

In view of the said report and in view of no objection against said report till date filed by the petitioner, the matter is dismissed on merit. (Abhijit Gangopadhyay, J.)
