charge-sheet has already been submitted before the learned jurisdictional court, as such, learned advocate for the petitioner prays that the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail.

However, one of the accused is still absconding as is reflected from the records.

Learned advocate for the State draws the attention of the court to the various documents.

Having considered that the prosecution intends to examine 12 witnesses and the prescribed punishment is for a fixed term imprisonment as also the fact that some time

will be required to examine 12 witnesses as relied upon by the prosecution, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Md.

Ashikur Rahaman shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the ACJM, Basirhat.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of North 24 Parganas without prior permission of the learned Trial court. Accordingly, CRM (M) 918 of 2026 is allowed.
