Opposite party was granted bail on humanitarian grounds. He does not stand on the same footing with co-accused whose bail was turned down on merits.

In view of the aforesaid fact and as the order is an interlocutory one, we do not wish to interfere with the same. It is open to the State to agitate its grievance at the time of confirmation of bail in accordance with law.

Accordingly, the application for cancellation of bail is disposed of.
