Learned Counsel for the petitioners submits that the petitioners' private land has been encroached upon by the P.W.D. The petitioners had informed the P.W.D. authorities in July, 2020 but no steps were taken by the said authorities under the relevant provisions of West Bengal Highways Act, 1964.

Learned Counsel for the State submits that the P.W.D. may be directed to consider the representation of the petitioners since the disputes involve issues which only the P.W.D. can decide.

In view of the above, W.P.A.6149 of 2020 is disposed of with a direction on the respondent nos.2 and 4 being the Junior Engineer, P.W.D. and the Executive Engineer, P.W.D.

respectively to consider the representation dated 13th July, 2020 at page 49 of the writ petition. The concerned respondents will pass a

reasoned order upon hearing all concerned parties within a period of six weeks from date. A copy of such order will be given to the petitioners within a week from the date on which such reasoned order is passed.

The application being CAN 1 of 2020 (CAN 4440 of 2020) is disposed of accordingly.
