For State respondent The petitioner intends to be appointed as a Court No. 24 23.12.2021 (Item No. 21) (AB) Primary School Teacher. In compliance of the direction passed by the Court on 27th April, 2015 in WP 8131 (W) of 2015 a special interview was conducted for the petitioner.

It appears from the submissions made on behalf of the District Primary School Council, Malda that the lowest marks obtained by the last empanelled candidate in the panel under the category SC is 28.51. After conversion of the vacant seat from EC (SC) to SC the lowest marks obtained by the last empanelled candidate is 28.

It has been submitted that the petitioner has obtained 13.09 marks. The said mark was given after addition of the marks obtained by the petitioner in the interview.

As it appears that the petitioner has scored less marks than the last empanelled candidate, accordingly he does not fall within the zone of

consideration. No relief can be granted to the petitioner in the instant writ petition.

The writ petition fails and is hereby dismissed. The final merit list for the appointment of Primary School Teachers as prepared by the Malda District Primary School Council is retained with the records.

As the final merit list has already been published and the petitioner has become unsuccessful to obtain a place in the same accordingly no useful purpose will be served by keeping the earlier writ petition being WP No. 8131 (W) of 2015 pending. The same is treated as on day's list and is hereby dismissed.
