Sufficient materials have been produced by the petitioner in support of her contention that Money Execution Case filed by the petitioner-wife for implementation of an order of alimony passed in her favour is pending for an indefinitely long period. Accordingly, CO No.950 of 2021 is disposed of by requesting the Additional District Judge, Fourth Court at Howrah to dispose of Money Execution Case No. 15 of 2019, arising out of Matrimonial Suit No.490 of 2012, pending in the said court, as expeditiously as possible, positively within one month from the date of communication of this order to the court below.

The petitioner shall communicate this order, along with server copy, on the learned advocate(s) appearing for the opposite party in the court below as well as on the court below at the earliest.

The trial court shall act on the written communication of this order by the learned advocate for the petitioner, accompanied by server copy, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
