C.R.R. 1083 of 2021 Court No.

Item 50 Ssi In the matter of:- M/s. Rangbarshi Projects Private Limited 30.03.

(via video conference) Mr. Ajay Chaubey Ms. Shakshi Rathi ...for the petitioner This is an application seeking an expeditious disposal of a proceeding under Sections 138 and 141 of the Negotiable Instruments Act.

Affidavit of service filed on behalf of the petitioner is taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the complainant in this case. The instant proceeding was initiated in 2018. The private opposite parties are the accused in this case. The matter is pending at the stage of hearing of the applications under Sections 205 and 305 of the Code. The next date is fixed on 22.06.2022. The matter has remained pending for no fault of the present petitioner.

I have heard the submissions of the learned counsel appearing on behalf of the petitioner and have perused the revision petition.

No prejudice will be caused to anyone if a direction is passed to expedite the proceeding. It appears that an inordinate delay was occasioned in concluding the impugned proceeding, especially in view of the statutory stipulation for an early disposal of the case under the Negotiable Instruments Act.

In view of the above and in the interest of justice, I request the learned trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of six months from the next date of hearing.

With these observations, the revisional application is disposed of.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
