Nobody has tried to join in on behalf of the petitioner. This is a fairly old matter of 2017. The grievance of the petitioner sought to be ventilated through this writ petition styled as Public Interest Litigation is that the Kalimpong Regulated Market Committee has been transferred by the State Government to the Gorkhaland Territorial Administration (in short 'GTA') under a notification dated 16 November, 2012.
We have heard learned Additional Government Pleader for the State administration. It is submitted that the State has appointed an Administrator under which the GTA is functioning. Further a Committee has been constituted by the Government which is overseeing the functioning of the Kalimpong Regulated Market Committee.
The petitioner has, inter alia, prayed for a writ in the nature of mandamus directing the concerned respondents to
re-constitute a marketing committee as per statute. These are matters essentially for the State Administration to consider. We find no reason to keep this writ petition pending and it appears that the petitioner is not interested in the matter any more.
Accordingly, we dispose of the writ petition without prejudice to the petitioner's right, if any, to approach an appropriate forum for redressal of any further grievance that he may have.
