For the State On hearing learned advocate representing the petitioner, it appears that though prayer is made for sanction of family pension in favour of the petitioner who is a widow daughter of a deceased employee of school, however, such application of the petitioner for sanction of family pension is not supported by legal heir certificate being issued by the appropriate authority. In absence of legal heir certificate, no relief can be granted to the petitioner.

Hence, present writ petition stands dismissed. However, this order shall not preclude the petitioner to take steps for obtaining legal heir certificate and in the event legal heir certificate is obtained, petitioner shall be at liberty to approach the concerned State respondents for sanction of family pension in accordance with law.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
