Versus

The State of West Bengal & Ors.

(Via Video Conference) [[ Mr. Abhishek Prasad Mr. Sougata Mitra Ms. Ankita Dey .....For petitioners Mr. Sujit Sankar Koley .....For W.B.S.E.D.C.L.

Mr. Ayan Banerjee .....For State Affidavit of service filed in Court be kept on record. Mr. Abhishek Prasad, learned advocate appears on behalf of petitioner. He submits, that his client is land loser. On the land being acquired he was promised employment. To that effect his client's representation dated 3rd March, 2020 at page 39 onwards of the writ petition. Mr. Sujit Sankar Koley, learned advocate appears on behalf of West Bengal State Electricity Distribution Company Limited (W.B.S.E.D.C.L.). He submits, his client does not have particulars of acquisition of petitioner's land and, therefore,

that petitioner is a land loser appears to be a bald allegation. Petitioner has not been able to provide any basis for his claim of being awarded employment on the basis of losing land. Mr. Ayan Banerjee, learned advocate appears on behalf of State.

West Bengal State Electricity Distribution Company Limited (W.B.S.E.D.C.L.) will consider and deal with the representation dated 3rd March, 2020. To that end the company might require petitioner to furnish documents to prove basis of his claim, being acquisition of his land by or for the benefit of the company. The exercise must result in a reasoned order to be made by the company within four weeks from date of communication of this order. It is expected that the company will deal with the claim meticulously. However, if petitioner is unable to provide the basis for his claim then there will be no claim to be dealt with.

The writ petition being, W.P.A. No.6169 of 2020 alongwith connected application being, IA No:CAN 1of 2020 (Old No.CAN 4466 of 2020) are disposed of as above.
