Mr. Debashish Roy, ld. PP Mr. Karan Bapuli ... for the State Learned counsel for the petitioner submits that the petitioner had sold some goods to the opposite party No.2 in the period 1996-97. A cheque for Rs.10 lakhs given by the opposite party No.2 was dishonoured. A money suit was started. The opposite party No.3 also took some money for constructing a building, but did not do so. He gave a cheque in lieu of the same that was also dishonoured. A compromise was thereafter arrived at and the two private opposite parties issued a cheque of Rs.33 lakhs. But, the same was also dishonoured. A complaint case was started in 2020. Since 15.07.2022, the matter is pending for execution of warrant of arrest against the accused. As a prayer has been made to expedite the proceeding, no prejudice will be caused to anyone if an order is passed without serving notice to the other side.

It appears that there is a delay in concluding the proceeding and in having warrant of arrest executed.

In view of the above, the learned trial court is directed to conclude the proceeding in accordance with law and at the earliest, more particularly to have the warrant of arrest executed upon the accused, in default, to proceed to the next stage for issuance of proclamation.

Accordingly, the revisional application is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
