Mr. Ranjan Saha ......... for the State The grievance of the petitioner is that the cut off Court No. 24 08.02.2022 (Item No. 2) (AB) marks fixed in the reserved category was more than the cut off marks fixed in the General Category.
Learned advocate representing the North 24 Parganas District Primary School Council has produced the notice published by the North 24 Parganas District Primary School Council with regard to the Primary Teachers Recruitment Process - 2009 wherein the lowest cut off marks for the different categories and medium for eligibility to appear in the written selection test held on 20th February, 2012 is mentioned.
It appears that in the Hindi medium category, in which the petitioner participated, the lowest cut off marks in the General Category is 71.33 and the lowest cut off marks in the SC Category is 71.25.
The apprehension of the petitioner that the cut off marks in the Reserved Category was more than the General Category is not substantiated from the notice which has been produced before this Court today. The petitioner has
not challenged the notice by which the cut off marks in different categories have been fixed.
The petitioner being an unsuccessful candidate cannot challenge the selection process and fixing up of minimum cut off marks by the examination conducting body after publication of the merit list.
In view of the above, no relief can be granted to the petitioner in the instant writ petition.
The writ petition fails and is hereby dismissed. Let the notice produced by the learned advocate representing the North 24 Parganas District Primary School Council be retained with the records.
Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
