Affidavit of service filed be kept with the record. Records of the case reflect that Special Leave to Appeal was granted on 06.03.2024.

Appeal was admitted on 23.09.2024.

Subsequently, direction was passed for service upon the respondents but none appeared.

From the records of the case it reflects that the subject matter of appeal related to dismissal of the complaint for non appearance of the complainant and the accused being acquitted under section 256(1) of the Cr.P.C. The said order was passed on 16.12.2023 in connection with Case No. 49643/21.

Having considered that the case was not decided on merits and the complaint case was dismissed only for non appearance of the complainant, I am of the view that the complainant must be granted an opportunity.

Needless to state that service has been effected upon the private respondents, yet none appeared on behalf of the

respondent. Having regard to the same the order dated 16.12.2023 is hereby set aside.

Accordingly, CRA (SB) 65 of 2024 is allowed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
