AGP Mr. Parikshit Goswami ... for the State-respondent(s) Mr. Kaushik Dey Mr. Debdipto Banerjee ... for the respondent nos. 5 and 6 The petitioner is aggrieved by the fact that in spite of an injunction order passed by the learned Civil Court, the private respondents are violating the order and, in spite of informing the police authorities, no steps have been taken.

It is also alleged that the construction is progressing in spite of the injunction order dated 13.02.2025.

Learned advocate for the private respondent(s) submits that T.S. 137 of 2025 is already pending, there are history of cases between the petitioner and the private respondents. Earlier, several writ

petitions were filed by different sets of persons and, there were no interference by this Court.

Mr.

Yusuf, learned advocate, appears for the State and submits a report which reflects that another Title Suit being T.S. 705 of 2023 is pending.

In view of the nature of the dispute between the petitioner and the private respondent(s), the police authorities would be strict to implement any order passed by the learned Civil Court.

However, if any sanction plan is there, the police authorities will not interfere with the same.

In view of the petitioner and the private respondent(s) are at loggerheads, the police authorities would ensure that there is no breach of the peace and/or tranquility taking place as also no untoward incident resulting because of the inimical relationship existing between the

parties.

With the aforesaid observations, WPA 8255 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Since affidavits have not been invited, the allegations made in the writ petition are deemed not to have been admitted.

Report so submitted be kept with the record.
