AGP Mr. Soumen Chatterjee ... for the State-respondent(s) The petitioner is aggrieved by the fact that in spite of informing the police authorities on or about 03.03.2025, no steps have been taken and an unauthorized construction is still in progress without any permission.

State has submitted a report prepared by the Inspector-in-charge of Deganga Police Station, which reflects that there are several litigations pending inter se the parties including civil and criminal cases. The first of such suit is T.S. 992 of 2022 which is pending. Series of cases under Sections 144(2) of the Cr.P.C. is

also pending being Deganga P.S. Case No. 286 of 2018; Deganga P.S. Case No.

170 of 2019; Deganga P.S. Case No. 391 of 2019; Deganga P.S. Case No. 389 of 2019; Deganga P.S. Case No. 483 of 2019; Deganga P.S. Case No. 139 of 2019 and, Deganga P.S. Case No. 684 of 2024.

Having regard to the series of criminal cases pending inter se the parties, the police authorities would ensure that without any order from the civil court, no illegal act be committed by any of the parties.

In view of the history of the criminal cases as is reflected in the report, the police authorities would be strict in ensuring that if there is any violation, State would apply for cancellation of bail before the jurisdictional court.

The police authorities would further ensure that there is no breach of the

peace and/or tranquility taking place as also no untoward incident resulting because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 8259 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copy of the report without annexure be handed over to the petitioner.
