The petitioners are aggrieved by the fact that the promoter and co-residents have created a nuisance by setting up a badminton court next to his premises in a building complex. It is submitted that the promoter is also in favour of removal of such badminton court. The petitioner has lodged a complaint to the Belghoria Police Station. The Belghoria Police has found badminton court existing.

This Court notes that the dispute between the petitioners and the private respondents is purely civil in nature and police have no role to play in the matter. The petitioners may avail appropriate civil remedies against the private respondents.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
